Denials of NON-IMMIGRANT visas by USCIS due to non issuance of client letter by Infosys, TCS

Placements of H-1B, OPT consultants at client locations of Infosys and TCS receiving RFE’s and denials from USCIS

Difficulty in getting extension / Amendment / or change of status of non-immigrant visas while working for Infosys and TCS clients. 

As we are aware that USCIS has issued new memorandum in the month of February 2018 for filing paperwork / documentation while applying the extension / Amendment / or Change of status of non-immigrant visas. Its mandatory to have the detailed client letter addressing hired consultants designation, roles and responsibilities, duration of assignment, along with explanation relationship with Implementing partner/Tier 1 vendor; Along with client letter, to support the application for filing extension / Amendment / or Change of status of non-immigrant visas, companies have to support the application further documents such as Vendor /Implementation Partner letter, Master Service Agreement, and work order.

But we came to know from sources that Infosys and TCS are unable to provide the letter and also unable to request client to support with letter, thus making approval of H-1B visa very difficult, and most of the cases are either receiving an RFE or denials from USCIS. ority60
